The Visa Bulletin is released monthly and covers issues that pertain to travel outside of your country for three months or less. For those three months, the only time restrictions are those that apply to international travel. There are some instances where an international visitor may be authorized to stay beyond their three-month visa validity period, but these situations are limited to particular countries and do not affect all others. Also, as previously mentioned, there are some cases where an individual with an international travel debit card can purchase items with their card outside of their country of residence and pay for them at a merchants participating in Visa/MasterCard Partner Program.

The Visa Bulletin highlights four categories of people who should take note of the visa year expiration date before traveling: students on study visas, dependents of student international travel students, authorized suppliers, and business travelers. While students on study visas are generally allowed to stay in the host country for up to three months, students not eligible for the student category under the student mobility category cannot extend their stay past the three month limit. Students on other categories of visas (including family immigration) are usually restricted to staying for at least six months in their host country, to the maximum stay for family members are seven or ten months. In either case, an extension to a previously established visa is usually not possible.

Students who are studying abroad and planning to study in a foreign university are required to declare the intent to leave the United States when applying for admission to the college of their choice. For students intending to stay outside of the United States after the visa year expires, they must also declare the intent to return to the United States at the time of application. If an adult (not a minor) wants to stay in the United States past the visa expiration date, they must apply for an immigrant visa. Once approved, the applicant can stay for up to three months, provided that they are otherwise eligible to remain in the United States. These individuals will need to apply for a visa once they are eligible to return to the United States.

A prospective immigrant may not apply for admission if they do not meet the following three month requirement. Those eligible for a visa must be in receipt of a visa, have applied for a visa, and have left the United States in advance of the expiration date. This three month rule is implemented to ensure that persons who wish to stay beyond the visa year are not eligible for re-admission into the United States. It is important to note that the three-month rule does not apply to Green Card lottery entries or those entering the program based on a job offer. Also, persons authorized to work in a U.S. diplomatic facility will not be allowed to extend their stay beyond the three months.

There are a number of common visa types that may be available to those wishing to stay beyond the visa year. The most common visa class is called the Nonimmigrant Visa. While it is possible to apply for this visa and stay in the United States for up to a year, it is not uncommon for individuals to be approved for a visa and then immediately sent back to their home country. Some may be eligible to apply for a tourist visa and then immediately return to their home country after three months.

A slightly different visa category than usual is the Tourist Visa. This visa allows travel outside of the United States for tourism purposes only. Some may also be authorized to stay in the United States on business visas, work permits, and other authorized grounds. Work travel, however, is not normally authorized. Those applying for Traveling Visa must first apply for a non-immigrant visa and then apply for a visitor visa.

The United States government has specific regulations for those who wish to participate in the H1 visa or the green card lottery program. Those who wish to participate in either program must apply for an immigrant visa prior to submitting their request for a US visa. Individuals who are approved for either visa are then required to enroll in the program by the month of March 2021. This ensures that millions of eligible immigrants will be allowed access to the United States once their paperwork is processed.

The United States government has created an automated system to determine when someone may qualify for either the immigrant visa program or the green card program. The system will notify applicants of their eligibility status every month. Applicants who do not attend their interview session may miss out on opportunities to become eligible for either program.
